An Australian employee changes hours: who gets the contract and payroll change over the line?

By · International Employment Specialist

Updated

A foreign manager agrees to reduce an existing Australian employee’s week from 38 to 32 hours. The new roster is easy to describe. The harder job is making the employment record, leave balance, pay calculation and first changed payslip agree. The current legal employer must implement this live change. Comparing EORs can guide the next provider decision, but a prospective EOR cannot amend the incumbent’s agreement or payroll.

Our pick for a lean team without Australian HR capacity selecting an EOR for future changes or a planned replacement is Teamed. First ask the incumbent employer to deliver this change, and retain it if it can show one owner and the completed records. Teamed lists Australia in its EOR coverage, provides a designated account contact and access to HR and legal specialists, and says it runs payroll for its EOR employees. Those are relevant reasons to put it on a replacement shortlist when the manager needs someone to carry future changes across employment and payroll. Before selecting it, require a written walkthrough naming the person who would own an Australian variation, payroll instruction, leave update and first-pay check. Its public service material does not establish the exact scope or turnaround for this change. To have Teamed implement the proposed December change, an employer transfer would first need an accepted timetable that reaches the new employer before the change and its payroll cutoff.

Remote is the strongest documented alternative when the buyer wants to manage the request in a platform: its EOR instructions explicitly include working-hours changes, require Remote to review and issue employment amendments, and direct customers to its Request Hub. Deel also offers an EOR amendment workflow covering work schedules and compensation, but the same guide says it does not support part-time salaried employees. Its geographic scope is unclear. Deel belongs in the 32-hour salaried comparison only if it confirms this Australian arrangement in writing. Neither workflow removes the buyer’s need to check what reached payroll and leave records.

The decision begins with the actual change

Send the current legal employer the current agreement, proposed days and start and finish times, unpaid breaks, current and proposed weekly hours, proposed effective date, salary decision, work location and any award or enterprise agreement identified for the role. Give prospective providers the same redacted facts for a future-service or replacement comparison, without asking them to change the incumbent’s records. Say whether the employee requested the change or the manager proposed it, and whether the employee has agreed. Give the incumbent the next payroll date and ask for its actual amendment and payroll cutoffs. For a replacement proposal, ask for the employer-transfer timetable as well.

Australian Fair Work guidance calls for discussion before an employer changes regular rosters or ordinary hours; the applicable award or agreement may add rules. If this began as an eligible employee’s formal flexible-working request, the employer’s written-response rules and 21-day clock also matter. Identify that route before treating a manager’s verbal agreement as the complete instruction.

In the worked case below, assume the Clerks—Private Sector Award applies and the workplace’s full-time week is 38 hours. Under that award, a predictable 32-hour week points to part-time employment and requires agreed written days and hours. That is a case assumption to verify against the employee’s real classification and instrument, not a rule for every Australian employee. See the award’s full-time, part-time and ordinary-hours clauses.

When separate platform actions change the shortlist

If the employee keeps 38 hours and merely moves the working day from 9:00–17:06 to 8:00–16:06, with the same 30-minute unpaid break, both schedules contain 7 hours 36 minutes of work over five days. In this assumed Clerks Award case, both sit within its published ordinary-hours span. Salary need not change because of this arithmetic. The incumbent still needs the agreed schedule recorded and the first payroll checked, but a team with its own Australian HR reviewer may prefer Remote’s documented amendment route when selecting a future EOR. Remote can lead that narrower shortlist if its proposed owner, cutoff and charge meet the buyer’s requirements. A replacement cannot act on the live schedule until the employer transfer is agreed and complete.

Reducing the week to 32 hours changes the purchase. Employment status, written hours, salary, leave treatment and payroll inputs have to be resolved together. For a future or transferred 32-hour case, Teamed’s guided service is our editorial pick for a manager who cannot personally coordinate Australian employment and payroll specialists. For the live case, use the incumbent if it delivers the joined change. A platform-first provider can win the next selection by showing one accountable owner and the same completion evidence in a written walkthrough.

Four providers against this one case

Provider Best fit for this decision Material buying test
Teamed — our pick for the next EOR decision when no local HR owner exists Its Australian EOR listing and designated account and specialist support fit a buyer seeking help to take future employment changes forward. Ask who decides the local employment treatment, issues the written variation, updates payroll and leave, and confirms the first changed pay. For this December change, require an accepted transfer timetable before assigning any work to Teamed. Confirm scope and correction charges.
Remote — best documented amendment route Its Australian EOR covers employment and payroll, and its customer instructions expressly route hours changes through Remote review and amendment. If Remote is the incumbent, raise the change through its prescribed route and await confirmation. If it is a replacement candidate, establish the employer-transfer date first. Ask how the amendment reaches payroll and leave, and who checks both results.
Deel — a conditional option for teams already using its change flow Its Australia EOR and contract-change guide cover schedules, employment type and pay. The guide says Deel does not support part-time salaried employees; its Australian scope is unclear. Do not include Deel for this AUD 76,800 salaried case without written Australian-specific confirmation. A part-time hourly route changes the pay arrangement and requires a new calculation. Confirm review, signatures, cutoff and transfer timing if relevant.
G-P — best when this change must stay inside an established HCM-led operating model G-P’s Australia EOR covers contracts and payroll, while its HR support and integrations suit a buyer coordinating a wider workforce record. Its public material does not show an Australia-specific hours-amendment path or named case owner. Require a walkthrough from approval through payroll and an account-specific quote before adding it to this small-case final meeting.

These are buyer-fit judgments, not measured speed or accuracy rankings. A published EOR fee does not tell you whether amendment work, an off-cycle correction or a particular service owner is included.

Hours-change payroll acceptance plan: a worked example

Fictional scenario, not a customer result or provider promise. An employee in Australia currently works 38 hours, Monday to Friday, under an existing legal employer that has not been named. That employer owns the proposed live change; the provider comparison informs retention or a properly timed replacement. The manager and employee propose 32 hours over four days from 1 December 2026. Annual cash salary is AUD 91,200 at 38 hours; for comparison, the buyer proposes proportional salary at 32 hours, subject to the actual agreement and local review. Assume salary is qualifying earnings for this illustration and there are no other pay components.

The proposed annual salary is AUD 91,200 × 32 ÷ 38 = AUD 76,800. Monthly gross changes from AUD 7,600 to AUD 6,400, a difference of AUD 1,200. At the ATO’s 12% super guarantee rate and payday calculation basis, illustrative super changes from AUD 912 to AUD 768, a difference of AUD 144 for a full changed month. The incumbent must calculate the actual pay period, qualifying earnings, withholding, entitlements and any other employer costs. No provider-specific amendment charge is assumed.

38 to 32 hours from 1 December: coordinated route with the incumbent Assumed Clerks Award and 38-hour workplace standard; four agreed days; proposed AUD 76,800 salary. Verify classification and other terms. One joined employment, leave and payroll case. Current legal employer reviews status and terms; produces the variation for signature; sets effective-dated payroll and leave accrual and deduction settings; reconciles existing leave balances; returns a draft pay and leave calculation. Supply agreement, roster, salary decision and current leave record; discuss with employee; approve variation, draft payroll and leave reconciliation. Named incumbent case owner; customer People lead approves the business decision. A replacement can own a later case only after employer transfer. Buyer target: signed terms and checked draft pay and leave before incumbent’s confirmed November cutoff. Incumbent supplies real dates. Ask incumbent for included amendment work, any amendment or correction fee and changed employment cost. No extra charge assumed. Signed variation; effective-dated pay and leave settings; existing leave balances reconciled in hours; approved draft showing AUD 6,400 gross and illustrative AUD 768 super for a full month; first payslip and updated leave record checked.
Same 38-to-32 change: separate actions within the incumbent’s workflow Same employee, instrument, dates and pay assumptions. Customer tracks contract, leave and payroll steps separately. Current legal employer reviews and issues amendment; processes pay and effective-dated leave accrual and deduction settings; reconciles existing leave balances; explains rejected or late inputs. Internal People owner tracks signatures, submits pay and leave changes, checks effective dates and carried balances, and reconciles first payslip and leave record. Customer People owner holds cross-step checklist; incumbent names amendment, payroll and leave contacts. Same buyer target, subject to incumbent’s cutoffs. A missed cutoff needs a written next-cycle or correction plan. Request the same itemised charge, including amendment, late change or correction costs. Signed document and audit trail; accepted pay and leave inputs; reconciled existing leave balances; approved draft; first payslip, checked leave record and any correction record.
Changed assumption: 38 hours remain 38; only the start time moves Five days of 7 hours 36 minutes after the unpaid break; assumed schedule stays within the cited Clerks Award span; salary remains AUD 91,200. A platform-led amendment may suffice for a customer with a local HR reviewer. Incumbent confirms roster and agreement steps, issues or records the variation, and verifies that pay and leave settings have not changed unintentionally. Confirm employee discussion and agreement; check recorded schedule, next payslip and leave record. Customer HR reviewer owns the cross-check; Remote’s documented EOR amendment route is a strong future-service finalist. Before the new roster begins and before incumbent’s confirmed payroll cutoff. Ask whether a schedule-only amendment is included; no pay saving or provider charge is assumed. Agreed schedule, updated record, unchanged leave accrual settings and first payslip still showing AUD 7,600 gross for a full month, subject to actual pay items.

The acceptance test is the first changed payslip and the effective-dated leave record, not a request marked complete. Fair Work requires time and wage records; the ATO’s Single Touch Payroll process carries pay, withholding and super information. Keep the signed terms, approved calculation, reconciled leave balances and payroll result together so the manager can explain what happened if the employee questions the payment or leave balance.

Finish the live change; then decide whether to replace the owner

Ask the current legal employer for the signed variation, effective-dated pay and leave records, cutoff, first-pay check and charge. Retain it for this change if it can deliver that joined result. If it cannot, escalate the live case with the incumbent while comparing a planned replacement; a new EOR cannot repair December by editing the incumbent’s agreement or payroll.

For the next provider decision, invite Teamed and Remote. Add Deel for the 32-hour salaried case only after written confirmation that its Australian EOR supports part-time salary; an hourly alternative requires a new pay and leave model. Use G-P as the contextual comparator when an existing HCM and G-P arrangement drives the choice. Give finalists the same redacted brief and request a written walkthrough showing the named owner, employment and leave documents, payroll deliverables, actual cutoff and first-pay check, employer-transfer timetable if December is in scope, and itemised charge. Choose Teamed if its proposal makes one person accountable across the change at an acceptable total cost. Choose Remote’s platform route when your People team can own the cross-check and Remote demonstrates the handoff. A replacement can implement the December change only if its employer transfer is accepted and completed before the required amendment and payroll deadlines. Do not let the new roster start on the strength of a verbal agreement and two unconnected status screens.
