How does an employer of record in the UAE handle visa sponsorship and work permits?

The licensed UAE employing organisation handles the applicable work permit and residence process; an EOR contract alone is not permission to work.

In a mainland outsourcing arrangement, the agency is the employee’s employer. Free-zone employment follows the relevant authority’s process. The sequence can include an offer, permit, entry or status change, medical fitness, insurance and Emirates ID. Confirm the actual sponsor and authorised work location before the start date.

How is end-of-service gratuity calculated for EOR employees in the UAE?

For a foreign full-time employee covered by the federal Labour Law, gratuity normally starts after one continuous year: twenty-one days of basic wage per year for the first five years, then thirty days per further year, subject to the two-year-wage cap.

Use the last basic wage, excluding allowances; qualifying part-years are prorated. A registered savings-scheme arrangement changes how future benefits accrue.

Does using a UAE EOR create permanent establishment risk under UAE corporate tax?

Yes, permanent-establishment exposure can remain. A UAE EOR does not shield an overseas business whose people create a fixed place of business or habitually conclude, or substantially negotiate, its contracts in the UAE.

The Federal Tax Authority recognises specific exceptions, including certain temporary presence and non-core activity. Apply the actual duties, premises, authority and relevant treaty before relying on an exception.

Do Emiratisation requirements apply to employees hired through an EOR?

Yes, a recruitment or outsourcing business is not automatically exempt from Emiratisation. MOHRE says the requirement applies to registered establishments with fifty or more workers regardless of economic activity; the skilled-job target reaches 10% by the end of 2026.

Selected establishments with twenty to forty-nine workers have separate obligations. Assess the EOR’s registered establishment and your own establishment separately; do not assume outsourced staff satisfy your company’s quota.

Can an EOR employ someone in a Dubai free zone as well as the mainland?

A provider may support both, but one licence or visa does not automatically cover both locations. The employing entity, permitted activity and employee’s actual workplace must match the mainland or relevant free-zone permissions.

DMCC, for example, requires its own employee authorisation and says a free-zone visa does not itself permit mainland employment. Obtain the appropriate approval for a cross-boundary assignment.

What notice and termination rules apply under UAE Labour Law for EOR hires?

Under the federal Labour Law, ordinary termination requires a legitimate reason and written contractual notice of thirty to ninety days. Probation and lawful dismissal without notice have separate rules.

Pay outstanding entitlements, including qualifying gratuity, when employment ends; cancelling the client’s EOR service is not the employee’s dismissal process. DIFC and ADGM have separate employment regimes.

Does a UAE EOR register employees with MOHRE and pay them through WPS?

For a mainland employer within MOHRE’s system, yes: the employing organisation handles the employment registration and generally pays wages through WPS. The current framework is Ministerial Resolution 340 of 2026, with specified exemptions.

A free-zone arrangement needs its own authority-specific check. Request the named employing entity, permit record and payslip; an overseas invoice is not proof that local payroll was completed.

Can an EOR in the UAE use the voluntary end-of-service savings scheme instead of gratuity?

Yes, an eligible employer can enrol selected employees in the approved voluntary alternative scheme. Employer contributions are 5.83% of monthly basic salary for service up to five years and 8.33% above five years.

They are employer-funded, not deductions from employee salary. Preserve gratuity accrued before enrolment; the scheme replaces future accrual for enrolled employees. Separate compulsory financial-free-zone arrangements must be assessed on their own terms.

How long does it take to get a UAE employment visa through an EOR?

There is no single UAE-wide EOR visa deadline. MOHRE lists two working days for its overseas work-permit service; that is one stage, not the complete residence process.

DMCC lists twenty working days or less for its employee residence-visa service. Medical checks, insurance, identity registration, document corrections and external approvals affect the start date. Ask for a route-specific timetable with each dependency shown.
