How does an employer of record in Portugal handle the 23.75% employer social security contribution?

The EOR pays the employer contribution and includes it in your bill. Under Portugal’s standard rules, it is 23.75% of gross pay that is subject to social security.

On €42,000 a year, that adds €9,975, bringing the subtotal to €51,975 before other costs and EOR fees. The employee’s 11% contribution is deducted from their gross pay; it is not another employer cost.

Make sure the annual pay figure includes any holiday and Christmas payments due. Add workplace-accident insurance, benefits and the EOR management fee. Then check currency-conversion charges, markups and fees for extra services. A 2% conversion charge on €51,975 would add €1,039.50; that is an illustration, not a supplier quote. Is Portugal a good place to build a team via EOR before opening a Lda?

An EOR can be a practical first step for an eligible small Portuguese team if its legal employment model fits the work.

A lasting operation may justify an Lda when direct control and predictable scale outweigh formation and administration costs. Compare the same headcount over one and two years, including accounting, payroll, insurance, internal HR and employee-transfer work. Country attractiveness alone does not establish a cost crossover.

Do EOR employees in Portugal get 14 salary payments?

Yes, Portuguese employees normally receive holiday and Christmas allowances in addition to twelve monthly base-salary payments. These are often described as fourteen salary payments, but payroll timing and the allowance calculation must follow the law and applicable agreement.

State the annual gross package explicitly: if it already includes both allowances, do not add them twice. Entry, exit and some absence periods can require prorating.

What are the annual leave and working hours rules for EOR employees in Portugal?

The ordinary limit is eight hours a day and forty hours a week, with at least 22 working days of annual leave.

Collective arrangements and lawful working-time schemes can affect the schedule; the first employment year has specific leave-accrual rules. An EOR must apply those rules to the employee’s contract and records. Paid holiday is separate from the holiday allowance paid as part of remuneration.

How much does it cost to employ someone in Lisbon through an EOR in 2026?

A Lisbon hire on an illustrative €42,000 annual gross package costs €51,975 before insurance, benefits and EOR fees: €42,000 salary + €9,975 employer social security at 23.75%.

If the provider fee is assumed at €600 a month, the subtotal becomes €59,175. The salary here includes holiday and Christmas allowances. Add the actual workplace-accident premium and agreed benefits to obtain the final quote.

Can an EOR support a Portugal digital nomad or D8 visa?

The digital-nomad route is for remote work for people or organisations based outside Portugal. Ordinary employment by a Portuguese EOR company should therefore not be assumed to qualify just because the ultimate client is abroad.

The foreign-employer relationship and supporting documents must fit the route. If the employee will instead have local Portuguese employment, assess an appropriate local work-residence route before changing the contract.

Does the IFICI (NHR 2.0) tax regime apply to employees hired through a Portuguese EOR?

An EOR contract alone does not make an employee eligible for IFICI. The regime requires qualifying personal circumstances and a specified activity or role with the relevant eligible entity and certification route.

A tech job title or foreign client is insufficient. Obtain confirmation of the exact statutory category and employing-entity qualification before treating the 20% regime as part of the employee’s net-pay offer.

What are the termination and compensation rules for EOR employees in Portugal?

Portugal requires a lawful termination ground and the correct procedure; ending an EOR assignment is not itself a dismissal ground. Compensation depends on the route, contract and service dates.

Qualifying collective or role-elimination dismissals use the statutory service-based calculation, while fixed-term expiry and unlawful dismissal have different rules. Have the EOR separate notice, compensation, unused leave and salary allowances in the exit calculation rather than quote one universal severance percentage.

Are meal allowances (subsídio de refeição) tax-free for EOR employees in Portugal?

Meal allowances can be exempt from Portuguese income tax within the applicable daily limits and conditions. For 2026, the cash reference is €6.15 per worked day; meal vouchers receive the additional 70% limit, commonly shown as €10.46 after rounding.

Amounts above the exemption are taxable. This is not a tax-free fixed bonus payable for every calendar day or extra salary month.

How does a Portuguese EOR handle workplace accident insurance?

The employer must arrange workplace-accident insurance; social security contributions do not replace it. The EOR should declare the employee’s remuneration and actual work to the insurer and identify the insurer on payslips.

Confirm coverage for the work location and duties, including remote work where applicable. The premium belongs in the employer-cost quote and should not be presented as part of the 23.75% social security rate.
